Terms of Service
Last updated 23 August 2026. These terms are between you and m2Dev LLC.
1. Agreement
These terms govern your use of Swurl, operated by m2Dev LLC. By creating an account or using the service you accept them. If you accept on behalf of an organisation you confirm you have authority to bind it.
2. Accounts
You are responsible for the security of your credentials and API keys and for all activity under your account. Notify us promptly of any unauthorised use. Workspace owners may administer, suspend and remove members and may access workspace usage metadata.
3. Plans, credits and payment
- Paid plans renew automatically for the same period until cancelled.
- Credits are allocated monthly per seat, pooled at workspace level, drawn oldest-first, and expire 60 days after allocation. Credits carry no cash value and are not refundable or transferable.
- Usage beyond the credit balance is billed in arrears at published rates unless the workspace hard stop is enabled.
- Upgrades are prorated and immediate; downgrades take effect at renewal.
- Fees exclude taxes, which are added where required.
- Undisputed invoices unpaid after [30] days may result in suspension.
4. Your content
You keep all rights in what you send and what you receive. You grant us only the licence necessary to operate the service: to transmit your content to the model provider you or Auto-Route selects, and to store it so you can retrieve it. We do not use your content to train models. You are responsible for having the rights to submit what you submit.
5. Acceptable use
You may not use the service to break the law; to generate child sexual abuse material; to create malware, exploits or phishing content; to harass or defame; to infringe intellectual property; to circumvent our or a provider's safety systems; to resell raw model access outside your organisation without a written agreement; or to exceed rate limits by automated means. Your use must also comply with the acceptable use policy of whichever provider serves your request.
6. Model output
Model output can be wrong, biased, or fabricated, including output that looks confident and cites sources that do not exist. You are responsible for reviewing output before relying on it, and you must not present it as professional advice where a qualified professional is required. We make no warranty as to accuracy, fitness or non-infringement of output.
7. Availability
We aim for high availability and publish live status at /status/. Enterprise agreements may include a written SLA with service credits. Absent such an agreement, the service is provided on an as-available basis. We depend on third-party model providers and are not liable for their outages, though we route around them where we can.
8. Suspension and termination
You may cancel at any time; access continues to the end of the paid period and no partial refund is given except where required by law. We may suspend or terminate for material breach, non-payment, or where continued service would expose us or other customers to legal or security risk, with notice where practicable. On termination we delete your data as described in the Privacy Policy.
9. Warranties and liability
Except as expressly stated, the service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages or lost profits. Our aggregate liability is limited to the fees you paid in the [12] months before the claim. Nothing here limits liability that cannot lawfully be limited.
10. Indemnity
You will indemnify us against third-party claims arising from your content or your use of the service in breach of these terms. We will indemnify you against third-party claims that the service as provided infringes their intellectual property, subject to prompt notice and control of the defence.
11. Changes
We may update these terms with at least 30 days' notice for material changes. Continued use after they take effect is acceptance. If you object, cancel before the effective date.
12. Governing law
These terms are governed by the laws of the State of [TEXAS], excluding its conflict-of-laws rules, and the parties submit to the exclusive jurisdiction of the state and federal courts in [TRAVIS COUNTY, TEXAS].
